Terms of Use & EULA

These Terms of Use, together with the End User License Agreement set out in Section 14 (collectively, the “Terms”), govern your access to and use of the CrossIQ mobile application, the website at crossiq.app, and all related services (together, the “Service”). The Service is operated by [COMPANY NAME], a company organised under the laws of Turkey (“CrossIQ”, “we”, “us”, or “our”).

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy, which explains how we collect and process your personal data and forms part of these Terms.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country, which may be higher) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms.

You may use the Service anonymously or by creating an account. You are responsible for any activity that occurs under your account and for keeping your sign-in credentials secure. You agree to provide accurate information and to keep it up to date.

2. Licence to Use

Subject to your compliance with these Terms, CrossIQ grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Service for your own personal, non-commercial enjoyment. All rights not expressly granted are reserved.

3. AI-Generated Content

CrossIQ uses artificial-intelligence and large language model technology to generate crossword puzzles, clues, and related content from the topics you provide. To deliver this functionality, the topic text you submit may be processed by one or more third-party AI providers, and the specific provider or model used may change over time without notice.

AI-generated content is produced automatically and may be inaccurate, incomplete, offensive, or otherwise unsuitable. We do not guarantee the factual accuracy, originality, or quality of any generated puzzle or clue. You should not rely on AI-generated content as a source of truth. You are responsible for the topics you submit and must not submit content that violates Section 5.

4. Your Content

“Your Content” means any content you create, submit, or publish through the Service, including topics, generated puzzles you choose to publish, your display handle, profile details, and any reports or feedback.

You retain ownership of Your Content. By submitting or publishing Your Content, you grant CrossIQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, publish, display, and distribute Your Content for the purpose of operating, providing, improving, and promoting the Service. This licence ends when you delete Your Content or your account, except (a) for content others have already saved or interacted with, and (b) to the extent we must retain copies to comply with law.

You represent that you have all rights necessary to grant this licence and that Your Content does not infringe the rights of any third party.

6. Moderation & Reporting

The Service includes automated and/or manual moderation. We may review, filter, refuse, remove, or restrict any content, and may block users, at our discretion and without notice, to enforce these Terms or protect the community. You can report content or block other users from within the app. We are not obligated to monitor content but may do so.

7. Intellectual Property

The Service, including its software, design, branding, the “CrossIQ” name and logo, and all associated intellectual property, is owned by CrossIQ or its licensors and is protected by law. Except for Your Content and the limited licence in Section 2, nothing in these Terms transfers any intellectual-property rights to you.

If you believe content on the Service infringes your copyright, send a notice to contact@crossiq.app with: the work claimed to be infringed; the material you say is infringing and where it is located; your contact details; a statement of good-faith belief that the use is unauthorised; and a statement, under penalty of perjury, that your notice is accurate and that you are authorised to act. We will respond to valid notices and may remove the material.

8. Purchases & Virtual Items

The Service may offer optional in-app purchases, including virtual items such as hint credits (“✦”). Virtual items have no monetary value, are not redeemable for cash, and are licensed, not sold, to you. All purchases are processed by Apple under the App Store’s terms, and any refunds are handled according to Apple’s policies. We may modify, manage, or discontinue virtual items at any time.

9. Third-Party Services

The Service relies on third-party providers for hosting, authentication, AI generation, content delivery, and push notifications. Your use of the Service may be subject to those providers’ terms, and we are not responsible for third-party services. See our Privacy Policy for details on data processors.

10. Suspension & Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 7, 11–13, and 16) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING CONSUMER-PROTECTION RIGHTS YOU MAY HAVE UNDER TURKISH OR EU LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROSSIQ AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 50. NOTHING HERE LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

You agree to indemnify and hold harmless CrossIQ from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by us.

14. Apple & App Store EULA

The following terms apply when you obtain the app through the Apple App Store. This licence is between you and CrossIQ only, not with Apple, and CrossIQ is solely responsible for the app and its content.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

16. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-laws rules. The courts and enforcement offices of [CITY], Turkey will have jurisdiction, except that this does not deprive you of any mandatory consumer-protection rights or the right to bring proceedings in your country of residence where required by applicable law. If you are a consumer in the EU, mandatory provisions of the law of your country of residence continue to apply.
